Liability Disclaimer Agreement

In the Name of Allah, the Most Gracious, the Most Merciful

You hereby acknowledge that you (the "Participant") have carefully read this agreement and fully understood its content, and you agree to all the following terms for participating in the trips provided by the Agency:

1. Travel-Related Risks

Trips may involve a wide range of potential risks, whether known or unforeseen, natural, human, or personal. These risks include, but are not limited to: natural disasters such as earthquakes, floods, and landslides; severe weather fluctuations; epidemics and infectious diseases; physical accidents; bites or stings from animals or insects; security risks such as theft or assault; political or military unrest; transportation delays or loss of luggage; and legal or administrative issues at crossings and borders. The Participant acknowledges that all such risks are beyond the Agency’s control and assumes full responsibility for participation, aware that any of these risks may occur at any time.

2. Epidemics and Associated Costs

The Agency bears no responsibility for any financial or logistical losses resulting from epidemics or emergency health conditions, including but not limited to: cancellation or rescheduling of flights; imposition of quarantine (institutional or home); requirements for medical examinations before travel or upon arrival; flight delays or losses; or results that prevent the Participant from entering a specific country or boarding an aircraft. The Participant alone bears all costs associated with these cases, including alternative tickets, additional accommodation, examinations, and change or cancellation fees.

3. Visas and Documentation

The Participant bears full responsibility for obtaining all visas, permits, health certificates, and any other documents required to enter the destination or transit countries, whether before or during the trip. This includes ensuring passport validity, matching passport data with travel bookings, and complying with any additional requirements imposed by government authorities at destinations or transit points. The Agency bears no legal or financial responsibility resulting from the Participant being refused entry to any country, or their detention or delay for any reason, including lack of documents, errors therein, or sovereign decisions from immigration and passport authorities. The Participant bears all costs resulting from these cases, including alternative tickets, additional accommodation, fines, or any other legal obligations.

4. Insurance

The Agency may provide basic travel insurance according to the nature of the trip program, and the scope and terms of coverage are determined based on the insurance policy provided by the approved service provider. The Participant is responsible for reading and understanding the terms of the insurance policy and ensuring that the coverage suits their personal needs. The Agency bears no responsibility for accidents, injuries, losses, or costs resulting from circumstances or cases not covered by the insurance policy, including but not limited to: high-risk activities, pre-existing health conditions, or loss of personal property. The Participant is also recommended to obtain their own additional private insurance if necessary to cover cases outside the scope of the insurance provided by the Agency.

5. Emergencies and Remote Areas

Some trips may involve being in remote or isolated areas that lack advanced medical facilities, rapid evacuation means, emergency services, or basic infrastructure such as paved roads or communication networks. The Participant acknowledges and agrees to assume all risks associated with being in such locations, including delays in receiving medical care, difficulty reaching hospitals, or the unavailability of essential equipment or medications in the event of an accident or health emergency. The Participant also bears full responsibility for any damages, complications, or costs that may result from these circumstances and understands that the Agency is not responsible for providing private evacuation services or medical coverage not included within the announced scope of the trip.

6. Itinerary Modifications

The Agency reserves the full right to make any modifications to the announced trip plan, whether by changing the chronological order of activities, advancing or delaying daily programs, modifying transportation routes, or dividing participants into sub-groups according to safety requirements, weather conditions, or any organizational or logistical developments. These modifications are made to achieve the best possible experience for participants and in line with the general interest of the trip, without the Agency incurring any obligation to provide compensation in the event of a change in the content or sequence of the program, as long as the overall value of the trip has not been fundamentally affected.

7. Physical and Mental Readiness

The Participant must ensure they possess the physical fitness and mental health that qualifies them to participate in trip activities and that they do not have any chronic or emergency health or psychological condition that may affect their safety or the safety of others. The Participant also bears full responsibility for any complications or damages that may result from ignoring their health status or hiding important medical information from the Agency.

8. Negligence and Failure to Follow Instructions

The Participant bears full responsibility for any material, health, or legal damages resulting from their negligence or failure to follow the instructions and guidelines issued by the guides authorized by the Agency, whether during transit, activities, or at accommodation sites. This also includes deviating from the specified path or acting individually without coordination.

9. Conduct and Discipline

The Agency reserves the full right to terminate the participation of any individual in the trip if they commit any of the following behaviors: consumption or possession of narcotics or prohibited substances; harassment, verbal or physical abuse of any of the participants or guides; violation of the laws of the host country; or withdrawing from the group without permission. The Participant bears all costs resulting from this, including early return or legal proceedings.

10. Nature of the Trips

The trips organized by the Agency aim to provide cultural experiences and field adventures in a simple and non-luxurious atmosphere. They may include staying in traditional or modest places, eating local meals, and participating in activities that depend on physical effort or community interaction. The Participant acknowledges their approval of this type of trip and understands its nature in advance.

11. Images and Documentation

The Participant grants the Agency full permission to use images or visual clips in which they appear during the trip for marketing, documentation, or promotional purposes in any media outlet decided by the Agency, while respecting their privacy and not using the content in an offensive manner.

Final Acknowledgment

I hereby acknowledge that I have read all the terms and conditions set forth above, understand them fully, and agree to them without reservation. I also agree to release the Agency and its guides from any liability or legal claims arising from my participation in the trip, whether directly or indirectly.
